Bicycle rental liability release
By renting from Hammer And Cyclery and Re-Cycle, Inc. you are agreeing to the following.
In consideration of the rental of the above described equipment by Re-Cycle, Inc., I hereby release fully and discharge Re-Cycle, Inc., its owners, agents, and employees from any and all liability resulting from any personal injury to myself or damage to my property which is caused in any way by the negligent acts or failures to act of Re-Cycle, Inc., or any of its owners, agents, or employees in the adjustment, inspection, maintenance and/or rental of the equipment, and/or in the instructions given or not given to me concerning the equipment and its use, and/or from my use of this equipment. I accept for myself full responsibility for any and all injuries or damages of any kind which may result from the use of the bicycle and I will HOLD HARMLESS Re-Cycle, Inc., its owners, agents, and employees for any injury sustained by me while using the bicycle.
In the event that I am renting on behalf of another individual, I represent that I have full authority to do so, realizing this release is binding upon all renters as well as myself. I furthermore understand that it is my responsibility to inform those that I represent of the conditions of this agreement.
I acknowledge that I have carefully read this release of liability and understand its contents. I am aware that by signing this release, I am waiving certain legal rights, including the right to sue Re-Cycle, Inc.

I accept and clearly understand that there are inherent and other risks, dangers, and hazards associated in the sport of cycling for which this equipment is to be used which can result in serious injury or death and that injuries are a common and ordinary occurrence in this sport. I further recognize and acknowledge that the risks inherent in the sport of cycling can be greatly reduced by taking lessons, obeying all cycling laws, wearing a helmet, refraining from the use of drugs or alcohol while operating the bicycle, and using common sense.
I FREELY ASSUME ALL RISKS OF INJURY ASSOCIATED WITH CYCLING. I further agree and understand that THIS IS A USED PRODUCT AND I ACCEPT FOR IT FOR USE IN AS IS CONDITION. Re-Cycle, Inc. makes no certifications or guarantees as to the soundness or the safety of the ride or the rider. The purchaser agrees to indemnify Re-Cycle, Inc. and its agents against liability arising from any use of the product or injury to the rider or anyone injured in the course of the operation of this bicycle.
Renter agrees to pay, and to protect, indemnify and save harmless Re-Cycle, Inc. and all beneficiaries, agents and employees of Re-Cycle, Inc. from and against, any and all liabilities, losses, damages, costs, expenses, causes of action, suits, claims, demands or judgments of any nature whatsoever arising from any injury to, or the death of, any person or any damage to property related to the operation of this bicycle or in any manner growing out of or connected with the use, non use, or condition of the bicycle or any part thereof or resulting from the condition thereof.
Renter agrees that he/she has had ample time to inspect the bicycle before purchase and accept full responsibility for its care while in my possession. I will be responsible for the replacement, at full retail value of any equipment rented from Re-Cycle, Inc. under this agreement, which is damaged or not returned. I agree to reimburse Re-Cycle, Inc. for any loss or damage of any kind to the rental equipment other than reasonable wear and tear. I agree to return all rented equipment by the agreed date, in good condition, to avoid additional charges.
I have made no misrepresentations to Re-Cycle, Inc. in regard to my height, weight, age, or cycling ability. All instructions on the use of my rental equipment were made clear to me and I understand the function of my equipment.
I agree there are no warranties, expressed or implied, which have been made to me concerning the above cycling equipment, and I accept the above bicycle equipment in is AS IS condition.
